Right of Withdrawal from the Contract and Return of Goods



  1. Pursuant to Article 27 of the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended), a Consumer who has entered into a distance contract or a contract concluded outside the business premises may withdraw from the contract within 14 days without providing a reason and without incurring any costs, except for the costs specified in Articles 33, 34(2), and 35 of the aforementioned Act.

 

  1. The Consumer should submit the statement of withdrawal within 14 days from the date on which the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the goods. In the case of a contract covering multiple goods delivered separately, in batches, or in parts, the period starts from the date on which the last item, batch, or part is taken into possession.

 

  1. To meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send the statement of withdrawal before the expiration of the above-mentioned period.

 

  1. The returned Goods should have the original, undamaged packaging from the manufacturer, be complete, and show no signs of use. The proof of purchase of the Goods, along with any other items/documents received by the Consumer in connection with the purchase of the Goods, should be attached. However, failure to meet these conditions does not affect the possibility of returning the Goods.



  1. The returned Goods should be delivered to the Seller at the address from which the Goods were shipped, and the withdrawal statement, available on the website www.e-buyit.com, should be attached. Failure to meet these conditions does not affect the possibility of returning the Goods but will facilitate a quicker refund to the Consumer.

 

  1. The above rights do not apply if the Consumer purchases a complete set. In such cases, a single purchase-sale agreement is concluded, and therefore, withdrawal can only be made from the purchase-sale agreement relating to the entire set, i.e., all the products (goods) included in it.

 

  1. The return of the Goods cannot be made via cash on delivery.



  1. The Consumer should return the Goods to the Seller or deliver them to a person authorized by the Seller for collection without delay, but no later than 14 days from the date of withdrawal from the contract, unless the Seller has proposed to collect the Goods personally. To meet the deadline, it is sufficient to send the Goods before the expiration of the period.

 

  1. In the event of withdrawal from the Contract, the Seller will refund the Consumer all payments made, including the costs of delivery, without undue delay and no later than 14 days from the date of receiving the Consumer's withdrawal statement, except for additional costs arising from the Consumer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller.

 

  1. The Seller may withhold the reimbursement until the Goods are received back or until the Consumer provides proof of shipment. The refund will be made using the same payment method that the Consumer used when placing the order or to the bank account number provided in the withdrawal statement.

 

  1. The Consumer is responsible for any decrease in the value of the Goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the item. In the case of a decrease in the value of the Goods, the Consumer will be informed by the Seller, and the refund amount will be reduced by the cost of the value reduction.

 

  1. In the case of a return of the Goods, the Consumer will bear the transportation costs of returning the Goods to the Seller according to the full transport rates.

 

  1. If the Consumer decides to return the Goods under the terms of this section, the sales contract is considered null and void.

 

  1. The right of withdrawal from a distance contract is not available pursuant to Article 38 of the Consumer Rights Act of May 30, 2014 (Journal of Laws 2017, item 683), in the following cases, among others: a) for the provision of services if the entrepreneur has fully performed the service with the express consent of the Consumer, who has been informed prior to the commencement of the service that the Consumer will lose the right of withdrawal after the service is fully performed; b) where the price or remuneration depends on fluctuations in the financial market, over which the entrepreneur has no control, and which may occur before the expiry of the withdrawal period; c) where the subject of the contract is a non-prefabricated item, made according to the Consumer's specifications or intended to meet their individualized needs; d) where the subject of the contract is a perishable item or one with a short shelf life; e) where the subject of the contract is a product delivered in a sealed package, which cannot be returned after the package has been opened for reasons of health protection or hygiene, if the package was opened after delivery; f) where the subject of the contract is items that, after delivery, are inseparably connected with other items due to their nature; g) where the subject of the contract is alcoholic beverages whose price was agreed upon at the time of the sales agreement, and which can only be delivered after 30 days, with their value depending on market fluctuations over which the entrepreneur has no control; h) where the Consumer explicitly requested the entrepreneur to come to carry out urgent repairs or maintenance; if the entrepreneur also provides other services than those requested by the Consumer or delivers items other than spare parts necessary for the repair or maintenance, the right of withdrawal applies to the additional services or items; i) where the subject of the contract is sound or video recordings or computer programs delivered in sealed packaging, if the packaging has been opened after delivery; j) for the delivery of newspapers, periodicals, or magazines, except for subscription contracts; k) concluded through a public auction; l) for the provision of services related to accommodation, other than for residential purposes, transportation of goods, car rental, catering, services related to recreation, or events of an entertainment, sports, or cultural nature, if the contract specifies the day or period of service provision; m) for the delivery of digital content not supplied on a tangible medium, if performance of the contract began with the express consent of the Consumer before the withdrawal period expired and after the entrepreneur informed the Consumer about the loss of the right of withdrawal.

 

  1. The provisions in this document concerning the Consumer apply from January 1, 2021, also to contracts concluded from that date with a Buyer who is a natural person entering into a contract directly related to their business activity, where it is evident from the terms of the contract that it is not of a professional nature for that person, as defined by the subject of their business activity, available under the regulations of the Central Register and Information on Business Activity.
