Terms and Conditions for Placing Orders and Making Purchases in the Online Store at www.e-buyit.com

§ 1 Definitions

  1. Seller or e-BuyIt – the entity selling goods located in Lublin (20-701), at Nałęczowska 18/118, with NIP: 9182120618, REGON: 387005820.

  2. Product or Products – movable goods (including software) subject to the sale agreement with e-BuyIt.

  3. Buyer – a business entity purchasing Products from e-BuyIt Poland for professional purposes directly related to its business activities, not a consumer under the provisions of the Civil Code.

  4. Store or Online Store – a platform for placing orders and purchasing Products online by the Buyer at www.e-buyit.com.

  5. Terms and Conditions – these terms and conditions for placing orders and making purchases in the Online Store.

  6. General Terms and Conditions of Sale of Products and Services – general terms for concluding and performing all sale agreements for Products or provision of Services by e-BuyIt Poland, submitting complaints, and returning Products.

  7. Complaint – notification from the Buyer to e-BuyIt Poland about a defect in the Product to exercise their rights under warranty or guarantee.


§ 2 General Provisions

  1. The Terms and Conditions constitute a model agreement within the meaning of the Civil Code and apply to placing orders and making purchases in the Online Store.

  2. The Terms and Conditions are available on the website www.e-buyit.com.

  3. For matters not regulated by the Terms and Conditions, the General Terms and Conditions of Sale of Products and Services, provisions on the provision of electronic services, and the Civil Code shall apply. In case of discrepancies between the Terms and Conditions and the General Terms and Conditions of Sale of Products and Services, the provisions of the Terms and Conditions shall prevail.

  4. The Buyer is obliged to familiarize themselves with the Terms and Conditions and the General Terms and Conditions of Sale of Products and Services before placing an order.

  5. Placing an order by the Buyer is equivalent to the Buyer’s acceptance of the Terms and Conditions and the General Terms and Conditions of Sale of Products and Services. If the Buyer declares that they do not accept the Terms and Conditions or the General Terms and Conditions of Sale of Products and Services, e-BuyIt Poland will refuse to process the order.

  6. A device with an internet browser supporting JavaScript is required for proper display and use of the Online Store. It is recommended to use Internet Explorer 10 or the latest versions of Firefox, Chrome, Opera, or Safari.

  7. In accordance with the provisions on the provision of electronic services, the Buyer using the Online Store is prohibited from placing unlawful content on the site.

  8. All Products and names appearing in the Online Store are used solely for identification purposes and may be protected trademarks of their respective owners.

  9. Differences between the appearance of the Product in the Online Store and the appearance of the Product delivered to the Buyer, resulting solely from the individual settings of the computer equipment used by the Buyer when placing the order (e.g., color shade, product proportions, etc.), do not constitute grounds for submitting a Complaint.


§ 3 Prices and Availability of Products

  1. e-BuyIt Poland reserves the right that the prices and other information about the Products in the Online Store do not constitute an electronic offer of sale nor an offer under the provisions of the sales agreement in the Civil Code.

  2. The prices of all Products in the Online Store are expressed in Polish zloty (PLN) and are net prices (excluding VAT). The final price shown in the cart will be increased by the applicable VAT rate, resulting in the gross price.

  3. The price of the Product in the Online Store is valid until stocks are exhausted.

  4. The Seller will make every effort to ensure that the availability information for Products in the Online Store matches the current stock levels. If part or all of the ordered Product is unavailable, the Buyer will be notified through the relevant product status on the website and in the order section.

  5. The Seller reserves the right to change the prices of Products in the Online Store, add information about new Products, conduct and cancel promotions, sales, or make other changes in the Online Store.

  6. In the case of promotions or sales where a limited number of Products are available, the order will be processed based on the order submission date or time until the products are sold out, at the price determined by the respective promotion or sale.


§ 4 Placing an Order in the Online Store

  1. The Buyer can place an order in the Online Store only after: a. accepting the provisions of the Terms and Conditions, the General Terms and Conditions of Sale of Products and Services, and the privacy policy, b. completing the registration form in the Online Store, during which the Buyer is required to provide accurate data necessary for the issuance of an invoice by the Seller.

  2. After placing the order, an electronic message confirming the order submission will appear.

  3. The acceptance of the order for processing will be confirmed by the Seller in the following forms: a. the appearance of the relevant status of the Product in the Online Store, indicating the generation of a shipping label by the Seller, b. the appearance of information in the "View All Orders" section, c. sending an email titled "Order No. [_]" to the Buyer, containing the confirmation of the order acceptance for processing.

  4. The sales contract is concluded when the Buyer receives an email titled "Order No. [_]" containing the confirmation of order acceptance for processing.

  5. e-BuyIt Poland reserves that Article 66 (1) § 1-3 of the Civil Code does not apply to sales in the Online Store.
